1. Acceptance of these Terms

These Terms & Conditions ("Terms") govern your access to and use of the Park$hare application, website at parkshareusa.com, and related services (together, the "Service"), operated by Park$hare Inc. ("Park$hare," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Park$hare is

Park$hare is an online marketplace that connects people who have parking spaces to share ("Hosts") with people who need parking ("Drivers"). Park$hare is not a party to any parking arrangement between a Host and a Driver, does not own, operate, or control any parking space, and does not provide parking itself. We provide the technology that facilitates listings, bookings, and payments between users.

3. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

6. Bookings, payments & fees

When a Driver books a listing, a booking contract is formed directly between the Driver and the Host. Payments are processed through our third-party payment processor. Hosts set their own prices. Park$hare charges a service fee on transactions, disclosed before a booking is confirmed. Cancellation and refund terms are as presented in the Service at the time of booking. 7. Community & HOA partnerships

Homeowners associations, condominium associations, and property managers ("Community Partners") may enroll shared or common parking areas and earn a revenue share on bookings, subject to a separate partnership agreement. A Community Partner represents that it has authority to enroll the parking areas it lists and to enter into such an arrangement on behalf of its community.

The Service is provided "as is" and "as available." Because Park$hare is a marketplace and not a party to parking arrangements, we do not guarantee the condition, safety, legality, or availability of any space, or the conduct of any user. To the fullest extent permitted by law, Park$hare disclaims all warranties and is not liable for any indirect, incidental, or consequential damages, or for disputes, loss, theft, or damage arising between Hosts and Drivers. Hosts and Drivers are encouraged to maintain their own appropriate insurance. [Insert any liability cap and insurance details reviewed by counsel.]

10. Indemnification

You agree to indemnify and hold Park$hare harmless from claims, damages, and expenses arising out of your use of the Service, your listings or bookings, or your violation of these Terms or applicable law.

11. Suspension & termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or to protect the Service and its users. You may stop using the Service and close your account at any time.

12. Governing law & disputes
